Text Messaging Terms and Conditions

These Text Messaging Terms and Conditions ("SMS Terms") govern the text messaging program operated by Ash Nichole Photos LLC ("Ash Nichole Photos," "we," "us," or "our"). By affirmatively opting in to receive text messages from us, you agree to these SMS Terms.
1. Program Description
Ash Nichole Photos LLC may send recurring automated text messages concerning photography inquiries, booking information, contracts, invoices, payment reminders, appointment or session reminders, preparation information, scheduling updates, gallery notifications, customer service, photography services, and promotional offers when promotional messages were included in the opt-in disclosure.
Messages may be sent using an automatic telephone dialing system or other automated technology. Consent to receive marketing text messages is not a condition of purchasing or booking any service.
2. Opt-In and Consent
You may enroll by actively selecting an unchecked text-message consent box on our website, submitting another documented opt-in form, texting an advertised opt-in keyword, or using another method that clearly indicates your agreement to receive the messages described at the point of consent.
By opting in, you confirm that:
You are the subscriber or customary user of the mobile number provided;
You are authorized to consent to messages at that number;
The information you provide is accurate; and
You will notify us if you stop using or control of the number changes.
3. Message Frequency
Message frequency varies based on your inquiries, bookings, appointments, transactions, and communication preferences. You may receive multiple messages during an active inquiry or booking and occasional promotional messages if you separately opted in to receive them.
4. Charges
Message and data rates may apply. Ash Nichole Photos LLC does not charge a separate fee for the text messaging program, but your wireless carrier may charge you according to your mobile plan. Contact your carrier with questions about your plan.
5. Opting Out
You may opt out at any time by replying STOP to any message from our texting number. We may send one final non-promotional message confirming your opt-out. After your request is processed, you will no longer receive text messages covered by that opt-out unless you later provide new consent.
We will also honor other reasonable requests that clearly communicate your desire to stop receiving text messages. An opt-out from text messages does not automatically cancel an existing photography booking, contract, invoice, or other obligation. We may continue communicating through email or another permitted method.

7. Supported Carriers and Delivery
Text-message delivery is subject to your wireless carrier and network availability. Carriers are not liable for delayed or undelivered messages. The program may not be available through every carrier, device, or location, and we do not guarantee that every message will be received.
8. Privacy

Mobile information will not be shared, sold, rented, or disclosed to third parties or affiliates for their marketing or promotional purposes. We may modify, suspend, or discontinue the text messaging program or these SMS Terms at any time. Any revised terms will be posted with an updated effective date. We may terminate participation when we reasonably believe a user has violated these SMS Terms, misused the program, or provided inaccurate information.
10. Disclaimer and Limitation
The text messaging program is provided on an "as available" basis. To the fullest extent permitted by law, Ash Nichole Photos LLC is not responsible for delayed, failed, misdirected, or undelivered messages; inaccurate contact information; carrier or network failures; or losses resulting from reliance on a text message. Nothing in these SMS Terms limits rights or remedies that cannot legally be limited.
11. Governing Terms
These SMS Terms supplement any photography contract, website terms, or other agreement between you and Ash Nichole Photos LLC. If these SMS Terms conflict with a specific written photography agreement, that agreement controls the photography services, while these SMS Terms control participation in the text messaging program.
